Terms and Conditions for Austradies.com (Customer Platform)

IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS PLATFORM. YOUR USE OF AUSTRADIES.COM CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

1. Introduction and Role of Austradies

Welcome to Austradies.com (“Austradies”, “we”, “us”, or “our”). Austradies.com is an online platform designed to connect individuals and businesses seeking trade services (“Customers”, “you”, or “your”) with independent trade professionals (“Workers”) who are registered on our separate worker platform, Austradies.net.

1.1. Our Role is Limited.

Austradies acts solely as a neutral facilitator and introductory platform. We provide the technology to enable you to post a request for a trade service (a “Job Request”) and to be matched with Workers who may be able to fulfill that request.

1.2. We Are Not a Party to Your Agreements.

When you accept a quote or offer from a Worker, you are entering into a direct contract with that Worker. Austradies is not and will not be a party to any agreement, contract, or transaction between you and a Worker. We do not perform the work, nor do we employ or subcontract any Workers.

2. Your Use of the Platform

By using Austradies.com, you agree and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into binding contracts.
  • All information you provide on the platform, including in your Job Request, is accurate, complete, and not misleading.
  • You will use the platform for its intended purpose of finding a Worker for a legitimate trade service need.

3. The Job Process

3.1. Job Requests.

You may post a Job Request detailing the services you require. You are solely responsible for the accuracy and detail of this request.

3.2. No Guarantees.

Austradies makes no guarantee that you will receive any quotes or offers from Workers, or that the Workers who respond will be suitable for your needs.

3.3. Direct Engagement with Workers.

You will communicate directly with Workers to negotiate the scope of work, timing, and price. You are responsible for making your own assessment of a Worker’s suitability, qualifications, and insurance.

3.4. Search Ranking Disclosure.

When you search for Workers, results are ranked based on a combination of factors including: (a) average customer rating; (b) proximity to your job location; and (c) the Worker’s membership tier level (Workers on higher-tier plans receive higher search priority). Austradies does not accept payment for individual search placement beyond the tier-based priority included in each Worker’s membership plan.

4. Disclaimers and Limitation of Liability

4.1. Workers are Independent Contractors.

You acknowledge and agree that all Workers using the Austradies platform are independent contractors and are not employees, agents, partners, or representatives of Austradies. They operate their own independent businesses. Any statement, action, or work performed by a Worker is solely their own and they do not represent Austradies in any capacity.

4.2. No Responsibility for Work Quality.

Austradies has no control over and accepts no responsibility for the conduct, performance, or quality of the services provided by a Worker. We do not guarantee the quality, safety, or legality of the services performed. Any dispute, claim, or issue related to the work performed must be resolved directly between you and the Worker.

4.3. No Vetting or Background Checks (Disclaimer).

While we require Workers to provide certain information on Austradies.net, Austradies does not conduct comprehensive background checks, criminal history checks, or verification of every qualification, license, or insurance policy claimed by a Worker. It is your sole responsibility to conduct your own due diligence before hiring a Worker, including:

  • Verifying their ABN (Australian Business Number).
  • Sighting their relevant trade licenses (e.g., electrical, plumbing).
  • Requesting and verifying their Certificate of Currency for public liability insurance.

4.4. Limitation of Liability.

To the maximum extent permitted by law, Austradies (including its directors, employees, and affiliates) will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. (i) your access to or use of or inability to access or use the platform;
  2. (ii) any conduct or content of any third party on the platform, including any Worker;
  3. (iii) any services provided by a Worker or any dispute with a Worker;
  4. (iv) unauthorized access, use, or alteration of your transmissions or content.

Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Austradies for the service (which is currently zero).

4.5. Non-excludable Guarantees.

The limitations of liability set out above do not purport to exclude, restrict or modify the application of any implied condition or warranty, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law (ACL) which cannot be excluded, restricted or modified.

5. Payments

5.1. No Upfront Payments to Austradies.

Austradies does not currently process payments for the services rendered by Workers. You do not pay us for the job itself.

5.2. Direct Payment to Worker.

You will arrange payment directly with the Worker based on the terms you both agree upon. Austradies is not responsible for any payment disputes.

6. Your Conduct and Content

You agree not to post any content or engage in any conduct that is unlawful, defamatory, abusive, or infringes on the rights of any third party. We reserve the right to remove any content and suspend or terminate your account at our discretion.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. We will provide notice of any material changes by posting the new terms on this site. Your continued use of the platform after any such change constitutes your acceptance of the new Terms and Conditions.

8. Data Processing and Overseas Jurisdictions

To provide our services, your data may be processed by the following third-party service providers, some of which operate infrastructure outside Australia:

  • Supabase (database & authentication): Hosted on Amazon Web Services (AWS) in the Sydney, Australia region (ap-southeast-2).
  • Vercel (website hosting & CDN): Global edge network with primary compute in Sydney, Australia. Some edge functions may execute in other regions.
  • Stripe (payment processing): Headquartered in the United States with data processing in the US and Ireland. Stripe is PCI DSS Level 1 certified.
  • Resend (transactional email): Headquartered in the United States.

By using the platform, you consent to the transfer of your data to these jurisdictions. All service providers are bound by data processing agreements and maintain security standards consistent with the Australian Privacy Principles (APPs).

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Australia.
